We invoice for van and Man jobs in advance of the job, and balance payment is taken as soon as the job is complete.

If you are storing goods with us, then we invoice for storage every MONTH for payment in advance. Over a 12 month period, you receive 12 invoices. We require 30 days notice if you want to terminate your storage

Handy Van & Man OR Bucks Storage cannot insure your effects. You store effects at your own risk. If you need additional insurance please contact you home or business insurance provider or ask for information relating to alternative insurance suppliers.

Terms & conditions for storage with Handy Van and Man services.

We, Us and Our refer to Gorilla Marketing & Events Ltd, I, You and Your refer to the person or agent signing the contract for the client storing effects. Conditions means these terms and conditions that apply to this contract between Us and You.

1. Parking - Providing parking is the responsibility of the customer. If there are restrictions e.g. yellow lines, red routes, residents only, etc, you must provide a permit from the local council. If this is not possible, please be honest and let us know. If parking is legal try to reserve a space for the van outside before it arrives or call the local council and get a suspension or permit where necessary. If there is no parking pre-arranged any parking fines received will be the responsibility of the customer and must be paid by the customer on completion.

2. Congestion & Toll Charges - There will be an extra charge of £15 when passing through the London Congestion Charge Zone. Other congestion charge zones and tolls will be charged accordingly (unless otherwise stated).

3. Payment Requirements - You can pay by the following methods:

Merchant Machine

Online bank transfer (once date and time has been booked).

Cash on completion.

1. Arrival / Delivery Times - We will do our best to arrive within the time scale stated, however arrival times are estimated. Delays to pick-up/delivery times are sometimes unavoidable (due to traffic, accidents, weather etc). We do not accept any responsibility for any unforeseen or out of our control delivery/pick-up delays.  We have the right to choose the method and route by which to carry out the work.

2. Your Packing Responsibilities - We accept no responsibility for damage or breakage to items that have not been packed/protected by adequate means. Unless agreed by us in writing, we will not: Dismantle or assemble unit or system furniture (flat-pack), fitments or fittings.  Disconnect, re-connect, dismantle or re-assemble appliances, fixtures, fittings or equipment. Take up or lay fitted floor coverings. Move items from a loft, unless properly lit and floored and safe access is provided. It is the customer’s responsibility to dismantle any unit/system/flat pack furniture and beds and this should be done before our arrival. It is the customer’s responsibility to ensure that items will fit in the new premises (e.g. size of sofa and size of aperture). Our drivers will not be insured to remove doors or windows and in such cases, it is up to the customer to organize a specialist if needed.

4. We reserve the right to add extra costs due to unforeseen circumstances (eg. waiting for keys or gaining entry, incorrect addresses and so on).

5. Unless agreed by us in writing, we will not:

   1. Dismantle or assemble unit or system furniture (flat-pack), fitments or fittings.

   2. Disconnect, re-connect, dismantle or re-assemble appliances, fixtures, fittings or equipment.

   3. Take up or lay fitted floor coverings.

   4. Move items from a loft, unless properly lit and floored and safe access is provided.

   5. It is the customer’s responsibility to dismantle any unit/system/flat pack furniture and beds and this should be done before our arrival. It is the customer’s responsibility to ensure that items will fit in the new premises (e.g. size of sofa and size of aperture). 1. Unforeseen Circumstances

     We reserve the right to add extra costs due to unforeseen circumstances (eg. waiting for keys or gaining entry, incorrect addresses and so on).

1. Postponement or Cancellation - If you postpone or cancel after your booking is confirmed you will be charged 50% of the confirmed quote. If you postpone or cancel within 48 hours of the date of the job you will be charged the value of the job in full.  Please note we take all bookings in good faith and may have turned other work away for the day of your booking.

2. Staff Abuse - If the driver is forced to leave the job because of abuse from the customer or their acquaintances, verbal or otherwise, the customer will still be liable to pay in full.

3. Insurance - It is a condition of our insurance to obtain a valued inventory in respect of the goods, signed by the owner of the goods, prior to commencement of transit.  Any claim under our RHA insurance is subject to an excess fee of £250, to be paid by the client unless otherwise agreed in writing. Please check your items before our team leaves. Claims cannot be made once our team have left the premises and you have signed in accordance with the invoice.

4. Whole agreement - These Terms and Conditions together with our quotation are intended to form the whole agreement between us (Handy Van And Man and you the customer) and to prevail over any verbal discussions. Should we mutually agree to any variation of these terms such variation should be confirmed in writing. Any variation however agreed shall never invalidate the remainder of these Terms and Conditions.

5. Ownership of the goods - By entering into this agreement, you guarantee that: The goods to be removed are your own property, or

The person(s) who own or have an interest in them have given you authority to make this contract and have been made aware of these conditions.  You will pay us for any claim or damages and/or cost brought against us.

1. This contract and licence constitutes the entire agreement between the parties. You acknowledge that You have not relied on any statement, promise or representation made or given by or on behalf of Us which is not set out in this contract and licence.

2. These Conditions apply to this contract and licence to the exclusion of any other terms that You seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

3. We raise invoices at the beginning of each month and require immediate payment within 14 days.

4. Our charges do not include insurance. Your effects are stored at Your risk. You are advised to insure Your own effects. You must declare a value of effects to Us.

5. We may supply additional services and quote as required.

6. Minimum storage period one month.

7. You will not use the container for any other than storage, without our permission. No working, causing a nuisance or obstructing access to other clients.

8. Goods NOT to be stored or moved:- Prohibited or stolen goods, drugs, pornographic materials, potentially dangerous, damaging, explosive, corrosive, gas or gas canisters, paints, firearms and ammunition. Precious stones or jewellery, money, deeds, securities, stamps, coins or collections. Plants or goods likely to encourage infestation, vermin or pests. Perishables or items requiring a controlled environment. Goods requiring a special licence. If any of these are submitted We will demand their removal immediately and You will pay Us for expenses, legal cost or penalties incurred by Us.

9. You confirm the effects for storage are Yours and or You have the authority to enter into this contract. You shall ensure that any information You provide to Us in respect of Your effects and numbers of boxes or other information relating to quantities etc to be stored are complete and accurate. As this is a self service storage facility We cannot and will not take responsibility for any of Your effects that are lost, stolen or otherwise taken.

10. You agree our agents may gain access to Your stored effects in case of emergency, if instructed by emergency services or if We need to move Your effects.

11. You agree payment is in advance, and that You will not withhold any part of the agreed charges. Any late payment will incur interest at a rate of 8% per annum above the Bank of England base rate from time to time. Interest shall accrue on a daily basis from the due date until the date of payment of the overdue amount, whether before or after judgment, and shall be compounded weekly.

12. Nothing in these Conditions shall limit or exclude Our liability for:

    1. (a) death or personal injury caused by Our negligence, or the negligence of Our employees, agents or subcontractors;

    2. (b) fraud or fraudulent misrepresentation; or

    3. (c) breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).

13. Subject to clause 10:

    1. (a) We shall not be liable to You, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with this contract, including any losses that may result from Our deliberate repudiatory breach of the contract; and

    2. (b) Our total liability to You in respect of all other losses arising under or in connection with this contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, including losses caused by Our deliberate repudiatory breach, shall not exceed the lower of either the value of the consideration paid under the contract or £1,000.

14. Except as set out in these Conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this contract.

15. Clauses 12 to 15 shall survive termination of this contract.

16. You shall pay each invoice submitted by Us:

    1. (a) within 14 days of the date of the invoice; and

    2. (b) in full and in cleared funds to a bank account nominated in writing by Us, and time for payment shall be of the essence of this contract.

17. All amounts payable by You under the contract are exclusive of amounts in respect of value added tax chargeable for the time being.

18. We will hold Your effects until all charges and fees have been paid. This includes any fees or charges We incur while holding Your effects, until payment in full is made.

19. Right of Lien. We will dispose or sell Your effects left in the store 30 days after non payment of charges. Any funds produced will be credited to Your account, after all charges and cost for disposal or sale have been met. Any shortfall will be invoiced and all debts pursued via our debt collection agency / small claims court. If your debt is not paid thirty (30) days after the due date or if You fail to collect the goods after We have required You to collect them or if You fail to collect the goods upon expiry or termination date of this licence, subject to Condition 19:

    1. We may sell the Goods as if We were the owner of the Goods.

    2. We will pass all ownership to the goods to the buyer.

    3. We will use the proceeds of sale to pay:

       1. First the reasonable costs incurred buy Us in administering the debt collection and sale process. these costs will include (for example) auction costs, removal costs, cleaning costs and charges for Our own time;

       2. Secondly to pay Your Debt and to hold any balance for you. We are not required to give you any interest on the balance; and

    4. If the proceeds of sale are insufficient to discharge:

       1. all or any part of the costs described in 19.31. and

       2. Your Debt, You must pay any balance outstanding to Us within fourteen (14) days of a written demand from Us, which will set out the balance remaining due to Us. Interest will continue to accrue on Your Debt until payment has been made.

       3. Before We sell the Goods, We will give You notice in writing (provided by email, and/or where We consider it necessary, by hand, registered letter or recorded delivery service) of the amount of Your Debt at the date of the notice and that if You do not pay Your Debt within 14 days of the date of the notice, We will sell the Goods. We do not agree to give You any further notice of any intended sale. If you do not pay your fees by the due date we may immediately and without notice to you withdraw any discounts.

20. If necessary, We will charge a minimum of £50 to clean the container or area, remove rubbish and make fit to supply to another client.

21. We reserve the right to amend Our charges periodically with 30 days notice.

22. You will pay a deposit equal to 4 weeks or 28 days storage, refundable by cheque only, within 14 days after the end of storage period, less charges for repairs or cleaning if required.

23. Late payments, missed payments or dishonoured payments will incur a £25 administration fee to be added to your account , or each letter, statement or notice We send You, in relation to late or missed payments, We will charge £10 administration fee.

24. We will hold credit and debit card details for future payments against storage or disposal cost. By signing this contract You authorise Us to debit any and all charges from these cards.

25. Any notices will be deemed effective immediately if served in person or 48 hours after posting.

26. Where the customer is two or more persons Your obligations under this contract shall be joint and several.

27. Access to the site is from 8.00am to 5.30pm Monday to Friday. Closed Saturdays, Sundays and Bank Holidays. Additional access by agreement and payment of charges if deemed appropriate.

28. We may terminate the contract and licence immediately without prejudice if any payments or licence agreements are not maintained.

29. If you use our van service, You will be responsible for the vehicle at all times. For the avoidance of doubt, this means that You will be liable for any damage or loss of the or any third party claims relating to the vehicle.

30. Force majeure:

    1. (a) For the purposes of this contract, Force Majeure Event means an event beyond the reasonable control of Herts Storage including but not limited to strikes, lockouts or other industrial disputes (whether involving the workforce of Herts Storage or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

    2. (b) We shall not be liable to You as a result of any delay or failure to perform our obligations under this contract as a result of a Force Majeure Event.

    3. (c) If the Force Majeure Event prevents Us from providing any of the services for more than 4 weeks, We shall, without limiting Our other rights or remedies, have the right to terminate this contract immediately by giving written notice to You.

31. Assignment and subcontracting:

    1. (a) We may at any time assign, transfer, charge, subcontract or deal in any other manner with all or any of Our rights under this contract and may subcontract or delegate in any manner any or all of Our obligations under this contract to any third party or agent.

    2. (b) You shall not, without Our prior written consent, assign, transfer, charge, subcontract or deal in any other manner with all or any of Your rights or obligations under this contract.

32. This licence is subject to English Law. By signing the contact You acknowledge and agree that You have read and understand the Conditions of this contract and licence.
